Terms and conditions

The General Terms and Conditions of the Radgonske gorice Online Shop are drawn up in accordance with the Consumer Protection Act (ZVPot-UPB2), based on the recommendations of the Chamber of Commerce and Industry and international e-commerce codes.

The Radgonske gorice online shop (hereinafter referred to as the "Shop") is operated by Radgonske gorice d.o.o. (hereinafter referred to as the "Provider").

The General Terms and Conditions of Business deal with the operation of the Radgonske goric d.o.o. online shop, the rights of the user and the business relationship between the provider and the buyer.

1. Accessibility of information

The Supplier undertakes to provide the following information to the Buyer at all times:

  • the identity of the company (name and registered office, registration number),
  • contact details that allow the user to communicate quickly and efficiently (email, phone),
  • the essential characteristics of the goods or services
  • availability of items (every item or service offered on the website should be available within a reasonable time),
  • the terms of delivery of the goods (method, place and time of delivery),
  • all prices must be clearly and unambiguously stated and it must be shown whether they already include taxes and transport costs,
  • method of payment and delivery,
  • the time validity of the offer,
  • the period within which the contract can still be withdrawn from and the conditions for withdrawal; and if and how much it will cost the buyer to return the goods,
  • an explanation of the complaints procedure, including full details of the contact person or customer service.

2. Provider

Online sales are carried out by the company Radgonske gorice Gornja Radgona d.o.o., Jurkovičeva ulica 5, 9250 Gornja Radgona, info@radgonske-gorice.si (hereinafter referred to as the Provider).

The company is registered in the PRS Business Register of Slovenia, registration number 5129494000. The date of entry in the register is 20.4.1990. The company is subject to VAT. Tax number: SI50521217. Radgonske gorice Gornja Radgona d.o.o. operates in accordance with the Act on Electronic Commerce on the Market (ZEPT) and the regulations adopted on its basis.

3. Offer of items

The items offered through the Radgonske gorice online shop are part of the offer or production programme of Radgonske gorice d.o.o. The prices of the items are presented as retail prices and include VAT, but do not include shipping costs.

4. Payment methods

The contract of sale between the Provider and the Buyer is concluded at the moment the Buyer places an order and receives an e-mail from the Provider confirming this order. The purchase contract (order) is stored electronically on the provider's server and is accessible to the buyer at any time in his user profile (My Account). If the buyer has not created a user profile, he can access the contract by sending a request to the following e-mail address prodajalna@radgonske-gorice.si; otherwise, you will always receive a printout of the order to your own email address when you place your order.

The provider offers the following payment methods:

  • by credit to the tenderer's account after the invoice has been issued
  • upon collection upon delivery (a commission of €1.90 including VAT is charged),
  • by debit or credit card (Mastercard, Visa, Maestro, Diners)


The supplier shall issue an invoice to the buyer on a durable medium, itemising the total cost of the purchase.

5. Prices

The prices of the items on the website are presented as retail prices, quoted in EUR and include value added tax (VAT). Prices do not include shipping costs. Prices are valid for electronic ordering of products via the online shop. Prices are valid in the case of payment by the payment methods indicated above, under the conditions indicated above. Prices are valid at the time of placing the order and have no predefined validity. Discounted prices are discounted regular prices valid for a fixed or indefinite period of time. The Provider reserves the right to change prices without prior notice.

6. Purchase procedure

When the user selects a product, it is added to the basket. By pressing the Buy button, the user places the order and an automatic e-mail is sent to the user with the details of the order (products, quantities, prices, user details and order identification). When the order is placed, it goes through three stages:

  • Order accepted - After successful order placement, the customer receives an email notification that the order has been accepted. Comprehensive information on the status and content of the order is always available to the Buyer on the Supplier's website.
  • Order Confirmed - If the customer does not cancel the order, it only goes to further processing. Once the order has been reviewed, the supplier checks the deliverability of the ordered items and confirms or rejects the order with a reason. The Supplier may call the Buyer's contact telephone number to verify the information or to ensure the accuracy of the delivery. Upon confirmation of the order, the supplier shall inform the buyer by e-mail of the next steps. The contract for the purchase of the ordered items between the Buyer and the Provider is irrevocably concluded at this stage.
  • Order completed - The supplier contacts the buyer by email within the agreed deadline. In the email, the Supplier informs the Buyer where to go in case of delay and where to go in case of a complaint.

7. Right of withdrawal, return of goods

The consumer has the right to notify the company within 14 days of taking delivery of the goods (to the following contact email address info@radgonske-gorice.si) to withdraw from the contract without having to give a reason for his/her decision. The only cost to the consumer for withdrawing from the contract is the cost of returning the goods. The goods must be returned to the trader within 30 days of the date on which the consumer gave notice of withdrawal (withdrawal from the purchase). The goods received must be returned undamaged, unopened and in the same quantity, unless the goods are destroyed, damaged, lost or reduced in quantity without any fault on the part of the consumer. As the packaging is an integral part of the product, it must also be returned in the same condition as it was when the product was received (i.e. undamaged, unopened and in unaltered condition). Due to the extreme sensitivity of our products, both the contents and the packaging, we recommend that you do so immediately in the event of withdrawal from the contract. Due to their nature, our products are very sensitive to improper storage, and it is possible that a product may be destroyed due to improper storage. When returning items where a promotional code has been used, these funds will be taken into account as a discount and will not be refunded on return (the amount paid will be refunded) and the amount paid will be returned to the user's TRR. Refunds will be made as soon as possible and at the latest within 30 days of receipt of the cancellation notice. Refunds shall be made exclusively to the customer's TRR. The return of the goods received to the company within the withdrawal period shall be deemed to be a withdrawal notice. The return of the goods must be accompanied by the customer's details, i.e.: name and surname, address, postcode and place of residence, TRR account number. The invoice and/or order number to which the return of the goods is linked should also be indicated. Goods may not be withdrawn from if they are personalised goods, i.e. goods which are made to the buyer's precise instructions and tailored to his/her personal needs.

8. Delivery

The tenderer will deliver the goods or services within the agreed timeframe. The supplier will endeavour to dispatch the goods ordered no later than the next working day after the order. The Provider reserves the right to dispatch the goods later, but never more than 5 working days after receipt of the order. The delivery time depends on the contractual partner for the delivery of the shipments and is beyond the control of the Provider. The Supplier reserves the right to withdraw from the contract and not to send the products (see section Cancellation of Liability). The Supplier will inform the Purchaser of this and agree with the Purchaser on a refund of the purchase price. The contractual partner for the delivery of the items is the Post of Slovenia, but the provider reserves the right to choose another delivery service if this will enable the order to be fulfilled more efficiently. Goods are delivered only within the territory of the Republic of Slovenia. For purchases and deliveries to other countries within and outside the EU, the buyer should contact the provider via e-mail: prodaja@radgonske-gorice.si or export@radgonske-gorice.si. The delivery cost is calculated automatically when ordering the goods and is part of the final price of the order. The delivery cost is as follows and depends on the weight of the shipment or from the value of the ordered products:

It is also possible to pick up the goods in person at Dom penine (Radgonskih goric doo store) in Gornja Radgona, during the regular working hours of Dom penine.

9. Security

The Provider shall use appropriate technological and organisational means to protect the transmission and storage of personal data and payments. For these purposes, the Provider shall use a 128-bit SSL certificate issued by an organisation authorised for this purpose. Credit card authorisations are carried out in real time with instant verification of the data with the banks. Card data is not stored on the provider's server.

10. Protection of personal data

The Provider undertakes to keep all personal data of the User secure at all times. The Provider shall store indefinitely the IP addresses of all visitors to the online shop, and for registered members: first and last name, e-mail address, contact telephone, primary and delivery addresses, country of residence, time and date of registration and archive of communication with the Provider. The Provider will use the personal data solely for the purpose of fulfilling the order (sending information material, offers, invoices) and other necessary communication. Under no circumstances will the user's data be passed on to unauthorised persons. The user is responsible for the protection of his/her personal data by ensuring the security of his/her username and password and by using appropriate software (anti-virus) to protect his/her computer.

11. Disclaimer

The Provider shall use its best endeavours to ensure that the information published in the Online Shop is up-to-date and correct. However, the characteristics of the products, the delivery date or the price may change so quickly that the supplier is unable to correct the information in the online shop. In such a case, the provider will inform the buyer of the changes and give the buyer the opportunity to withdraw from the order or to exchange the ordered item. We reserve the right to exceptionally (partially) withdraw from the execution of the order in cases where the ordered products are no longer deliverable, if we determine an increased payment risk of the buyer, if the order form has not been completed in accordance with the general terms and conditions or if there is an obvious error in the price list. In all such and similar cases, we will inform you immediately of any withdrawal from the contract on our part. We also reserve the right to disable the website or to prevent access to the website due to technical or other problems and maintenance. In this case, we reserve the right to cancel orders placed which have been affected in any way by the technical fault. In this case, the supplier will also inform the customer of the changes and the further steps to be taken. All photographs in the online shop are symbolic and do not guarantee the characteristics of the product.

12. Communication

The Provider will contact the User by means of distance communication only if the User does not expressly object. The advertisement e-mails will contain the following elements:

  • they will be clearly and unambiguously identified as advertising messages,
  • the sender will be clearly visible,
  • various campaigns, promotions and other marketing techniques will be labelled as such. The conditions for participation in them will also be clearly defined,
  • a clear explanation of how to opt-out of receiving advertising messages,
  • the user's wish not to receive advertising messages will be explicitly respected by the provider.

13. Personal data / privacy policy

At Radgonske gorice d.o.o. we are aware of the importance of the security of your personal data, we invite you to read below how Radgonske gorice, d.o.o. handles your personal data. You will learn what personal data we collect about you, on what basis we collect it and for what purposes we process it. The privacy policy of Radgonske gorice d.o.o. complies with the law of the Republic of Slovenia and the GDPR Regulation, and covers:

  • contact information of Radgonske gorice d.o.o. and contact details of the Data Protection Officer,
  • the legal bases and purposes for processing personal data,
  • the types of personal data we collect,
  • the use of cookies and related technologies,
  • manage your privacy settings,
  • the provision of personal data,
  • retention periods for personal data,
  • protection of personal data,
  • the rights of individuals with regard to personal data, including the right to lodge a complaint,
  • changes to your privacy policy.

14. Purposes and use of data

Radgonske gorice Ltd collects, records, processes, stores, transfers and otherwise processes the personal data we hold about you for a variety of purposes.

  • Identification of the individual,
  • to provide customer support,
  • in the case of purchases, for the purpose of order execution (delivery, delivery of products, invoicing, settlement of any customer claims (complaints, guarantees),
  • to store your purchase history,
  • to carry out any recovery procedures and for their own accounting and tax needs.

15. What personal data do we collect?

  • Basic personal data: name and surname, date of birth, email address, residential address, delivery address, telephone number and password to ensure the security and use of our services,
  • the account details of the online shop,
  • details of your purchase and how to pay,
  • we collect technical information from your browser, computer or mobile device.

16. What are cookies and why are they needed?

A cookie is a short text that a website sends to your browser when you visit. This is how the website recognises you, remembers information about your visit and provides you with a friendlier and simpler online service. We use cookies to personalise the content on our website, remember your preferences and record your visit to our online shop. Browsing our online shop is more pleasant, faster and above all more efficient with cookies. The amended Electronic Communications Act, which came into force at the beginning of 2013, introduced new rules regarding the use of cookies and similar technologies to store or access information stored on a user's computer or mobile device. Individuals have a constitutional and legal right to the protection of their data - the right to self-determination of their information privacy and in this sense cookies are an interference with their privacy. This is why the new legislation restricts the use of cookies. The new legislation does not prohibit the use of cookies, but tightens the rules - under what conditions and how cookies and similar technologies can be used. The key point is that users of websites must be aware of cookies and must be offered a choice as to whether they want the website to track their online activities in this way.

17. Breach of terms and conditions

The Customer fully understands and agrees that the Provider reserves the right to take any appropriate action that may be necessary in the event of a breach of the articles of this document. Such measures include immediate restriction or (temporary) closure of access to the server system and other services without prior warning. The Customer undertakes to protect its passwords and all other confidential information relating to its user account and to notify the Provider immediately in the event of unauthorised or suspected interference with its user account. Unauthorised access includes suspected theft and/or loss of data, alteration of passwords or other security information, or any other event that may cause or allow unauthorised access to the Customer's User Account.

18. Complaints and disputes

The Provider complies with applicable consumer protection legislation. The Provider shall make every effort to comply with its obligation to establish an effective complaint handling system and to designate a person whom the Customer may contact by telephone or e-mail in the event of a problem. A complaint shall be submitted via the following e-mail address info@radgonske-gorice.si. The complaint procedure is confidential.

19. Out-of-court settlement of consumer disputes

In accordance with the legal norms, we do not recognise any provider of out-of-court settlement of consumer disputes as competent to settle a consumer dispute that a consumer may initiate in accordance with the Act on Out-of-Court Settlement of Consumer Disputes. Radgonske gorice d.o.o., as a provider of goods and services offering online commerce in Slovenia, publishes on its website an electronic link to the Online Consumer Dispute Resolution Platform (ODRP). The ODRP is available to consumers at the link HERE. The above-mentioned regulation is based on the Act on Out-of-Court Settlement of Consumer Disputes, Regulation (EU) No 524/2013 of the European Parliament and of the Council on online dispute resolution for consumer disputes and amending Regulation (EC) No 2016/2004 and Directive 2009/22/EC.

20. Legal notices

The Radgonske goric d.o.o. webshop, all data on it, all graphic or visual and video elements on this page are protected and may not be reproduced or used without the prior written permission of the company. The sale and supply of alcoholic beverages to minors (persons under 18 years of age) is prohibited. Therefore, the customer must be of legal age at the time of placing the order. Otherwise, the supplier shall immediately withdraw from the contract. By accepting the General Terms and Conditions, the Buyer confirms that he/she is over 18 years of age at the time of purchase. Health Minister warns: excessive drinking is bad for your health!
